[1] Whether a vessel carrying harvested fish entering into a port of the Republic of Korea falls within the purview of the Convention on the Conservation of Antarctic Marine Living Resources, adopted by Korea, and certain conservation measures restricting the reloading of vessels established by the Commission for the Conservation of Antarctic Marine Living Resources (affirmative)
[2] The disposition was proper in its restriction of the reloading of tooth fish shipped on a tooth fish carrier vessel that had entered into the port of Busan, Korea, for the purpose of unloading, as the ruling is in accordance with the Convention on the Conservation of Antarctic Marine Living Resources, to which the Republic of Korea is a party, and relevant conservation measures established by the Commission for the Conservation of Antarctic Marine Living Resources.
