[1] The principle of res judicata in relation to the appearance of new active damages following the conclusion of arguments in a previous proceeding in which compensation for active damages was ordered
[2] Where the life expectancy of a victim of injuries who is in a vegetative state is extended compared to a previous estimate, the requirement of additional future medical care, assistance devices, care giving, etc., shall be considered as new major damages that could not have been predicted at the time of the conclusion of arguments in the previous proceedings and as such not in conflict with the principle of res judicata.
