In a case where Defendant, the pastor in charge of Church A, was indicted for violating the Labor Standards Act and the Act on the Guarantee of Employees’ Retirement Benefits by failing to pay a portion of the wages and retirement benefit owed to B within 14 days of the resignation date, after B had worked for approximately five (5) years and eight (8) months following his appointment as an evangelist at Church A by Defendant prior to resigning, considering all circumstances, the court found Defendant guilty of the charges regarding unpaid wages and retirement benefit, on the grounds that B qualifies as an employee under the Labor Standards Act.
