Summary
The case granting a judicial divorce under Article 840 subparagraph 6 of the Civil Act as to the claim for divorce by a resident escaping North Korea upon the finding that there is a ground for a judicial divorce in light of the total circumstances such as the breakdown of a marital life between the plaintiff and the defendant already happening in North Korea, uncertainty as to whether the spouse having lived in North Korea resides in the South Korea currently, and the fact that it is highly unlikely that the situation where South and North Korea residents could not freely visit each other and exchange correspondences due to the military demarcation line separating Korea will change in the near future
