Standards for determining whether a person constitutes “a person who knowingly receives such personal information” in the latter text of Article 71 Subparag. 5 of the former Personal Information Protection Act
In a case where the right to control and manage information, with respect to a living individual who can be specified and is identifiable, has been transferred to a person who has obtained the information of the said individual by watching, etc. a personal portrait or body feature video-recorded by a visual data processing device, or personal information, which exists in the form of a video, whether the above person constitutes “a person who knowingly receives such personal information” in the latter text of Article 71 Subparag. 5 of the former Personal Information Protection Act (affirmative)
