In cases where, to secure a monetary claim, a trustor has set up under the Trust Act a trust under which the trustor would transfer real property in the trustor¡¯s possession to the trustee, with the monetary obligee as the preferred beneficiary and the trustor himself/ herself as the beneficiary, with the proviso that in the event of default, the entrusted real property would be disposed of and appropriated for the repayment of the aforementioned claim, whether the preferred beneficiary interest is also transferred to a third party solely on account that the monetary claim is transferred or assigned to a third party, or whether the preferred beneficiary interest lapses solely on account that the monetary claim and the preferred beneficiary interest accrue to different parties (negative)
