[1] Whether the act of using an ovum for an interest in property, or for any other consideration violates Article 13(3) of the Bioethics and Safety Act, which forbids and punishes trading ovum for value; and whether Article 51(1)5 of the Bioethics and Safety Act applies to an offer of passive interests, such as reduction of debt in return for ovum donation (affirmative), and to where the ovum is used for generating somatic cell cloned embryo (affirmative) [2] In a case where the Defendant was indicted for violating the Bioethics and Safety Act by conspiring with party ¡°A¡± to acquire the ovum from those women who visited A¡¯s infertility clinic in return for reducing their fertility treatment fees, etc., the case affirming the lower court¡¯s judgment that the Defendant¡¯s act constitutes ¡°using ovum for an interest in property, or any other consideration¡± prohibited under Article 13(3) of the Bioethics and Safety Act
