[1] Requirements for an administrative agency¡¯s refusal to take action following a citizen¡¯s affirmative filing of an application to constitute administrative disposition that may be the subject of an appeal litigation [2] In a case where: (a) personal information, etc. available on portal sites were leaked, resulting in the illegal disclosure of the resident registration number of Party A and others; (b) Party A and others accordingly filed an application to have their resident registration number changed with the head of the competent district office; and (c) the district office notified Party A and others to the effect that their request for resident registration number change was denied on the ground that ¡°change of resident registration number is impermissible in cases where illegal leaks occurred,¡± the case holding that: (a) it is deemed reasonable to acknowledge an individual¡¯s right to demand change of his/her resident registration number based on sound reasoning if it was leaked against one¡¯s will; and (b) the district office¡¯s refusal to adhere to the request by Party A and others for the change of their resident registration number fell under an administrative disposition that is the subject of an appeal litigation |
