| TITLE | Enhancement of Criminal Deposit Notice Procedure |
|---|---|
Notice Period Sent to the Prosecution Reduced Previously, notifications of criminal deposits were either submitted in person to the Court's criminal division, located in the same building as the deposit office or sent by postal mail to the prosecutor. This method often resulted in the prosecution receiving deposit notifications later than the Court. In cases when a defendant makes a criminal deposit closer to the court ruling date, the prosecution was unable to find out about the victim's thoughts and had difficulties presenting this to the Court before the Court pronounces the judgment due to time limitations. The National Court Administration recognized the need for improvement and took steps to address the issue. On January 29, 2024, an official letter was sent to deposit offices in each court, outlining guidelines for handling criminal deposits. The improved process will allow the prosecution to identify the criminal deposit at the same time as the court, and consequently will be able to consider the victim's opinions promptly. With the introduction of electronic criminal proceedings, the deposit office will be able to swiftly transfer the notification of criminal deposit to the prosecution via electronic means, further improving the efficiency of the process. |
